    What Is A Divorce Appraisal?

A divorce appraisal is a professional valuation of marital assets—most commonly the home—done specifically for use in a divorce so the property can be divided fairly between spouses. It provides an objective estimate of fair market value that lawyers, mediators, or a judge can rely on when working out a settlement.

    Basic Definition

A divorce appraisal is an evaluation of the fair market value of assets owned by one or both spouses, usually focused on real estate like the marital home. It is typically performed by a licensed or certified appraiser who prepares a formal report that can be used in negotiations or in court.

    Why It Matters In Divorce

The main purpose is to support equitable (fair) division of marital property by giving both sides a credible, neutral number instead of guesses or estimates. Courts and mediators often rely on these appraisals as evidence when deciding who keeps which assets, whether one spouse must "buy out" the other, and how much money should change hands.

    What Gets Appraised

Most commonly, the marital residence and any other real estate—such as rental properties, land, or vacation homes—are appraised. In some divorces, appraisals may also be obtained for businesses, investments, and valuable personal property so the overall division of the marital estate is based on current market values.

How A Divorce Appraisal Is Done

The appraiser usually inspects the property (inside and out), notes its size, condition, features, and upgrades, and then researches recent sales of comparable properties in the area. Using accepted valuation methods, the appraiser reconciles this data into a fair market value conclusion and issues a written report that explains how the value was determined.

How It Differs From A Regular Home Appraisal

A standard home appraisal is often done for a lender when buying or refinancing, while a divorce appraisal is tailored specifically for marital dissolution and court use. Divorce appraisals may involve more detailed analysis (for example, valuation as of a specific date such as separation) and are structured to stand up to legal scrutiny, rather than to satisfy lending guidelines.
